The constitutional order of the Republic of China is heading into that realm of, chaos right now, the one in power screamed loudly “a greater democracy”, but is actually, destroying democracy, shredding up our, constitution. In the setting of having five grand justices only, that doesn’t make the legal regulatory, the grand justices illegally declared the amendment for “constitutional claims law” unconstitutional, this is, stripping the legislature of its right to enact laws. The originally neutral constitutional court that has the ultimate right to rule if the bills are lawful, is now, held hostage by the political party. “The five-man court” became the breach of the imbalances of the constitutional legislative power; the president, Lai had, instilled his own will into the means, the Republic of China turned into the “Republic of Lai’s Will” now.
Looking through all the steps that took us up to here, the constitution getting destroyed, there’s the shadows of Lai and his will. For instance, how the head of Executive Department, Cho had weaponized the countersigning of the bills, he’d denied the validity of the legislations passed by the parliament, to announcing the founding basis for him not signing the legislation into law; although, he’d preached of the separation of powers, the democratic procedures, there’s no founding basis that’s constitutionally valid in his not signing. Cho’s only excuse, was off of how Lai called out to the legislators all gathering in then conference rooms, and ordered, that signing or not, signing but not implementing, is unconstitutional.
And, the five grand justices’ claiming the “constitutional claims” as unconstitutional, with the other three grand justices’ commenting that the evaluations of which, the decisions are, without founding basis of the law, that it is unconstitutional from the very start. The major fraction of the Constitutional Court, with the grand justices denying one another’s opinions on the bills, “one constitution, with each justice interpreting it individually, independently of one another.”, not only is this a civil war of the justice department, it’s also a microcosm of the political opposition of this country. But if the media press’s exposing that the Presidential Office’s having the higher up of the DDP to “talk to” Tsai, one of the grand justice on the bench, this showed how the executive branch had already, dipped its hands into the justice department. It’s no wonder that the outside realms questioned, that there’s the political forces, manipulating the executive and judiciary branches of our, government right now.
What is ironic is, on the Constitutional Enactment Day, there’s no public office that commemorated the occasion, only Lai, using the occasion to, harshly criticize the parties out of power of the presidential and executive offices, if you can’t even pass the budget bill in a timely fashion, what right have to, do talk about the policies? But the Executive department refuses to budget the fundings of wage increase for the military servicemen, the guarantees of retirement pensions of police and firefighters, and was against the stop cutting back of the annual wages of the school instructors, no wonder the legislature couldn’t pass the budget bill; the executive department refusing to enact the laws passed by the legislature, but blamed the parties out of power of the executive offices of government as unqualified to talk of policies. Lai used the subvert logic to get himself off the hooks, and scapegoated the responsibilities of the dissipating of the policies to the parties out of power.
The disputes of the Constitutional Courts, showed the same sort of a wayward logic: Lai’s unwilling to nominate the grand justices who are neutral, but blamed the parties out of power, for paralyzing the constitutional courts.
The “Five Man Rule” showed their loyalties to the party, Lai is trying to flip the situation of the DDP’s losing power in the legislature, the amendments that were passed by the legislature, the “court of five” overturns. In the past, it’s winners take all, and now, as the DDP loses out, it wants to take all still, in the futures, there’s only the high intensity of political opposition, the party in power not countersigning, not implementing the legislations passed by the legislature, announcing that the bills passed as unconstitutional, when the parties out of power start up impeachment, public vote, marching the streets in protest. The powers of parties in power of the presidency and out, butting heads, with the governance of the country, halted.
From refusing to enter the city councils for the meetings, to refusing to admit that the DDP is dual-minority in the legislature, it showed the means of governing by Lai; from expanding the powers of the executive department, to confiscating the powers to legislate of the legislature, it showed of how Lai had, turned the logics of how to govern upside down, that he had ZERO knowledge of the constitution; how he’d, turned the responsibility of the constitution into the weapons of constitutional enactment, showing how distorted Lai’s awareness of our constitution, is.
