This is BULLSHIT, with the scales of justice, completely, tilted toward the rights of the murderers, the perpetrators of crimes, inside of delivering JUSTICE to the victims and their, families, because the victims are already DEAD, so they don’t, count! The justice, in presiding over the case of the middle school student, Yang’s neck getting slashed by his classmate, proposed to the parents of the victim of the murder, “getting the adolescent who’d murdered your son to take care of you”, in attempt to start the restorative justice, causing the public to get really, upset; this sort of a restorative justice with nothing done to the perp, the manipulations, aren’t just adding to the sufferings, the losses of the victim’s families, it’s also, cheap, absurd, and may cause the opposite response from the restorative justice that the government aims, for.
The restorative justice is to offer the room for conversation for the victims impacted by the tragedy and the perps, to have them express their feelings, to amend the damages caused by the crimes, the process of both parties’ handling the consequences of a crime. Comparing to the current system of punishment in justice, this feeds more to the “healing of the traumas, to repair the damages in relationship”, with the ultimate goals of finding the truth of what happened, apology, comfort, taking responsibilities for one’s own actions, the get justice served while healing from the losses caused by the crime.

But based off of the case of the adolescent, Kuo, the adolescent girl, Lin who’d abetted the murder, the two wore their masks when they appeared in court, the attorneys hoped that they would take their masks of to answer the inquiries as respect toward the family of the victim they’d murdered, the two perp chose to ignore the request; the Association for Victim Support employees, were all warned by the attorney of the perpetrator to not have any contact with the press, and requested the justice to not allow the persons accused to sit in court during the testimonies of the victims’ families, there’s no show of the remorse on the perpetrators’ side.
The requests for restorative justice made by the defendants’ attorneys, the court couldn’t ignore, or, after the verdict is read, it would be grounds for a mistrial from the appeal courts. But as it is the victims of the families who’d proposed the restorative justice means, there’s the intentions of settlement, and this can easily become grounds for asking for a reduced sentence, and then, the impartial role of the court justice becomes, extremely important then, and, can’t it be any inquiries on what sort of a plan the perps have for making up for what they did? And to observe if there’s real remorse for the crimes by the perps? The original justice who’d asked the victim in asking “will you accept that the person who’d murdered your son take his place in fulfilling the filial piety duties toward you”, couldn’t she see, that the perp had no remorse, nor any plans to resolve, to make up for what he’d done to the, victim?
The female justice presiding over the trial, is normally very persistent, she was assigned to the head secretary of the Justice School this year, she may have known, that Yang’s parents would never accept the proposal of having the adolescents who’d brutally stabbed their son to death to fulfill the filial piety responsibilities toward them, or maybe, she’s just, “mentioning it” without much consideration, making a “casual offer” to resolve the issues? But, the court justices need to be aware of how much the words can hurt the families of the victims.
When the “fulfilling of filial piety responsibilities” became the detonator of the criticisms, we start wondering, “is this how cheap restorative justice gets?”, as the justice are looking over these requests, aren’t there any standard operating procedures that they follow?
And to the families of the victims who were murdered, won’t the feel that justice comes, too, cheaply? And, how can you ever make up for the loss of the lives that you took?
And so, this is, how uneven the balances in the justice systems is now, tipped in this country, there’s all these statements on the rights of the prisoners, making the death penalty unconstitutional, but where’s the other side of who’s going to make up to the families of the victims of these, murderers? Or, how CHEAP the lives of the murdered actually, are?
That’s just how the DDP works, they will do everything that they can, to ENFORCE these ideas that they expect us to accept, and this feeds to the passed amendment of making the death penalty unconstitutional, with absolutely ZERO respect, no rights of the victims and the families in the considerations!
